Terms of Service
Last updated: 15 July 2026. Please read these — they’re the agreement between you and us when you use EQ-3.
Who we are
EQ-3 is a service provided by Primordium Limited, registered in England and Wales (company number 17340607), registered office Bartle House, 9 Oxford Court, Manchester, M2 3WQ. In these terms, “we”, “us” and “EQ-3” mean Primordium Limited. “You” means you, the person using EQ-3. By using EQ-3, you agree to these terms. If you don’t agree, please don’t use the service.
What EQ-3 is
EQ-3 offers immersive audio “sessions” — sound, and gentle visuals — that you can play. It includes:
- Sessions — audio experiences you can access or buy and play.
- The Peace Channel — a free, shared ambient stream.
- Creative — sessions produced from audio by invited creators, sold in packs.
Important: what EQ-3 is not
EQ-3 is an audio and creative experience. It is not a medical device, and it is not a health, medical, therapeutic, or treatment service. We make no medical, health, or wellness claims. EQ-3 is not intended to diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional medical, psychological, or other advice. If you have any health concern, please speak to a qualified professional. You use EQ-3 as an experiential sound product, and you’re responsible for using it sensibly (for example, at a comfortable volume, and not while doing anything that needs your full attention, such as driving).
Using EQ-3
You agree to use EQ-3 only for lawful, personal purposes, and not to: copy, redistribute, resell, or publicly perform our sessions or content except as these terms allow; interfere with or attempt to disrupt the service; or misuse it in any way that harms us or other users.
The Peace Channel is provided free, for personal listening. It’s a gift, offered as-is.
Buying sessions and packs
When you buy a session or pack, you’re buying digital content for your personal use. Prices are shown before you buy. Payment is handled securely by our payment provider.
Your right to change your mind (14-day cancellation) — and an important exception. Under UK consumer law, you normally have 14 days to cancel a purchase of digital content and get a refund. However, this right is lost once the digital content has been supplied (downloaded or streamed), if you asked for it to be made available immediately and acknowledged that you’d lose the cancellation right by doing so.
Because our sessions are delivered to you straight away, when you buy, you’ll be asked to confirm that you want immediate access and that you understand you’re giving up your 14-day right to cancel once access begins. If you confirm this and we’ve given you access, the purchase isn’t refundable simply because you’ve changed your mind.
Faulty or misdescribed content. None of the above affects your legal rights if a session is faulty, doesn’t work, or isn’t as described. If something you bought doesn’t work as it should, contact us at office@primordium.co.uk and we’ll put it right — a repair, replacement, or refund as appropriate.
What you can and can’t do with what you buy
When you buy a session or pack, you get a personal, non-transferable right to access and play it for your own private use. You don’t own the underlying audio or gain any right to copy, share, resell, distribute, or publicly perform it. All rights in our sessions and content remain with us or our creators.
Our content and intellectual property
All content on EQ-3 — sessions, produced audio, visuals, designs, and the EQ-3 and Primordium names — belongs to us or our licensors and is protected by law. Nothing in these terms transfers any of that to you beyond the personal right to use what you’ve bought.
Availability
We aim to keep EQ-3 running well, but we can’t promise it will always be available or uninterrupted. We may change, suspend, or withdraw parts of the service, including sessions or the Peace Channel, at any time. We’ll try to give notice where we reasonably can.
Our responsibility to you
We provide EQ-3 with reasonable care. To the extent the law allows, we’re not liable for indirect or unforeseeable losses, or for losses arising from your use of EQ-3 in a way it isn’t intended (see “what EQ-3 is not”, above). Nothing in these terms limits our liability where the law doesn’t allow it to be limited — for example, for death or personal injury caused by our negligence, or for fraud.
Your data
How we handle your data is explained in our Privacy Notice. In short: we take as little as possible, keep the most personal things on your device, and never sell your data.
Changes to these terms
We may update these terms from time to time. We’ll post the new version with an updated date, and for significant changes we’ll try to let you know.
Law and disputes
These terms are governed by the law of England and Wales, and disputes fall to the courts of England and Wales. If you’re a consumer, this doesn’t take away any protection you have under the law of the country you live in.
